The seminar is co-organised by THECO-UC3M, the Instituto de Estudios Contemporáneos, Política y Gobernanza (UC3M), and the Seminario de Teorías Críticas (UC3M). Speak4Nature’s Seminar Series The seminar ‘Coordination between environmental criminal law and administrative penalty law: comparative lessons from the Spanish experience’ will address the recent incorporation of environmental offences into the Chilean legal system, particularly within the framework of the Economic Offences Act, which raises new challenges regarding the relationship between criminal law and administrative penalty law in the environmental sphere. In this context, the seminar aims to conduct a comparative analysis of the Spanish experience, whose criminal justice system includes established offences such as those set out in the relevant articles of the Criminal Code, which penalise various forms of pollution and damage to ecosystems, as well as unlawful conduct by public officials in environmental matters. Within this framework, we will examine the interaction between administrative mechanisms for environmental prevention and control and the criminal prosecution of the most serious environmental damage. Particular attention will be paid to the Environmental Liability Act, which regulates the interplay between administrative, civil and criminal liabilities. The aim of the seminar will be to identify the main institutional tensions, coordination criteria and evidential standards that have emerged in Spain, with a view to drawing useful lessons for the effective implementation of environmental criminal law in Chile. Biography: Tamara Catalina Navia Villagra, a Chilean lawyer, is graduated from the University of Chile and holds a postgraduate diploma in Economic Criminal Law and Economic Law. Since 2021, She has been a member of the Access to Justice Team at the NGO FIMA, whose aim is to bring the law closer to communities in order to protect the environment. As part of this work, she represents communities and organisations before the courts and public administration bodies in environmental matters.
